Fariah works as a client service agent for a sales service. She should work Monday to Friday from 9:00 a.m. to 5:00 p.m. in the organization’s office. She uses business’s telephones and computers. She is paid $25.50 per hour. Her employment agreement does not have an end date, although her employer can fire or discipline her for bad performance. Her employment agreement states that she is an independent contractor and so she does not receive overtime pay, trip pay or public holiday pay.

Fariah believes she may really be a staff member and might be entitled to overtime pay, trip pay and public vacation pay. She sues with the Ministry of Labour, referall.us Immigration, Training and .

A work standards officer examines her claim. The officer looks at the relationship between Fariah and the sales business and finds that she is a staff member

It does not matter that Fariah signed the employment agreement mentioning that she is an independent professional since the realities show she is a staff member.

The work standards officer orders the sales service to:

– pay Fariah the overtime pay, holiday pay and public holiday pay that she was entitled to as an employee.

– orders the employer to issue wage statements and keep records

Employee or independent specialist: Common misunderstandings

An individual might be thought about an employee even if:

– the specific and business concur (orally or in writing) that the person is an independent specialist. It is the relationship in between the private and business (or individual) that matters, not the label that is provided to it

– the individual:- charges the harmonized sales tax (HST).

– sends billings to the business.

– uses their own vehicle for work purposes.

Volunteers

Volunteers are not staff members under the ESA. However, the fact that someone is called a „volunteer“ does not figure out whether that person is a staff member and entitled to the securities of the ESA.

The primary elements that identify whether somebody is a volunteer or a staff member are how much:

– business (or person) benefits from the person’s services.

– the specific views the arrangement as being in pursuit of a living.

In family-run organizations, the question will frequently be whether the person is providing services in pursuit of a living or in service of the household.

If the individual is supplying services to the family, rather than services in pursuit of a living, that individual is more most likely to be a volunteer.

The fact that no salaries were paid does not necessarily mean that somebody is a volunteer. The truth that there was some type of payment does not necessarily suggest someone is an employee. For instance, an honorarium might have been paid, instead of salaries.
